These Terms of Use explain the rules for using our website, writersbynight.com (the "Site"). Please read them before using the Site. By accessing or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.
Separate terms apply to specific things you can do through us:
- Purchases of one-time products (workshops, manuscript evaluations, and similar) are governed by our Sales Terms.
- Writers By Night HQ membership is governed by our Membership Terms.
- How we handle your information is described in our Privacy Policy, which forms part of these Terms.
1. About us and how to contact us
The Site is operated by Danielle Kiowski, doing business as Writers By Night, a sole proprietorship based in New Mexico, USA.

2. Using the Site
The Site is intended for people who are at least 18 years old.
We're based in the United States and direct the Site to a U.S. audience. We don't promise the content is appropriate or available for use in other locations, and if you access it from elsewhere, you do so on your own initiative and are responsible for compliance with local law. The Site is written in English, and we aren't responsible for any translations applied to it.
By using the Site you agree not to use it in any unlawful way, not to interfere with its operation or security, and not to attempt to gain unauthorized access to any part of it.
3. Comments and content from other users
You may come across comments or content posted by other people on the Site or our related channels. We don't verify or endorse that content, and the views expressed by other users are theirs, not ours. If we become aware of comments that are abusive or harmful, we may remove them, but removal is at our discretion and doesn't entitle anyone to compensation.
4. Our content and intellectual property
Everything on the Site is our intellectual property or used with permission, and it's protected by copyright and other laws. This includes all text, graphics, images, audio, and video, the layout and design of the Site, and the content of our emails and social media channels.
It also includes our proprietary frameworks, systems, tools, names, and materials, such as (without limitation): the StoryPOWER System; the writing superpower framework and the names of the individual superpowers and squads; HERO Practice; Scribble; the Mission Generator and Resistance Decoder; and our worksheets, missions, trainings, tools, videos, diagrams, and downloadable resources.
You may view and use the Site's content for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, translate, sell, or create derivative or competing works from any of our content or frameworks, in whole or in part, without our prior written permission.

5. Purchases and memberships
Some products and services are available to buy through the Site. When you buy a one-time product, you enter a contract of sale with us on the terms set out in our Sales Terms. When you join Writers By Night HQ, our Membership Terms apply. Please review those terms before purchasing.
6. Availability of the Site
The Site is provided free of charge. We work to keep it available, but we don't guarantee it will always be available, uninterrupted, secure, or free of errors, bugs, or viruses. We may suspend, withdraw, or restrict all or part of the Site at any time, and we'll try to give reasonable notice where we can. You're responsible for your own devices and internet access, and for using your own security and virus protection.
7. Links to other sites
The Site may contain links to websites we don't control. Those links are provided for convenience and aren't an endorsement. We're not responsible for the content or practices of other sites, and you follow them at your own risk.
8. Privacy and cookies
How we collect and use your information, including our use of cookies and analytics, is described in our Privacy Policy at writersbynight.com/privacy. By using the Site, you acknowledge that we process information as described there.
9. Disclaimers
The content on the Site β including blog posts, emails, videos, and social media β is provided for general educational and informational purposes only. It reflects our experience and opinions, and it isn't professional advice for your specific situation.
We share teaching about writing craft, creative practice, and finishing your book. We make no guarantee about the results any individual will achieve, including whether you'll finish a manuscript, get published, or earn any particular income. Results depend on many factors that are outside our control, including your own effort and circumstances.
Nothing on the Site is legal, financial, medical, or other professional advice. If you need advice of that kind, please consult a qualified professional.
The Site's content is provided "as is." To the fullest extent permitted by law, we make no warranties, express or implied, that the content is accurate, complete, current, or fit for any particular purpose.
10. Limitation of liability
To the fullest extent permitted by law, we won't be liable to you for any loss of profits, loss of business or opportunity, or any indirect or consequential loss arising from your use of the Site.
Nothing in these Terms limits or excludes any liability that can't be limited or excluded under applicable law, including liability for our own fraud, or for death or personal injury caused by our negligence.
11. Indemnification
You agree to indemnify and hold harmless Danielle Kiowski / Writers By Night, and anyone acting on our behalf, from any claims, demands, losses, or reasonable costs (including attorneys' fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.
12. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted on this page, with the "Last updated" date above. Your continued use of the Site after changes are posted means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in New Mexico will have jurisdiction over any dispute arising out of the Site or these Terms.
14. General
These Terms, together with our Privacy Policy, Sales Terms, and Membership Terms (as applicable), make up the entire agreement between us regarding your use of the Site.
If any part of these Terms is found to be unenforceable, the rest stays in effect. If we don't enforce a provision on any occasion, that isn't a waiver of our right to enforce it later.
