If you have any questions about this policy or how we handle your information, email us at the address above.

1. The services this policy covers

This policy applies to:

  • Our website, writersbynight.com
  • The Superpower Quiz
  • Our email newsletter and marketing
  • Writers By Night HQ (our membership) and its community, tools, and AI assistant, Scribble
  • Our digital products, workshops, coaching, and manuscript evaluations
  • Any purchases you make through us

Some of these run on third-party platforms (for example, our membership and checkout run on Kajabi, and our emails run on Kit). Those providers have their own privacy policies, which we link to in Section 5.

2. Information we collect

Information you give us directly. Depending on how you interact with us, this may include:

  • Your name and email address (when you take the quiz, subscribe to emails, buy a product, or contact us)
  • Your quiz responses and the writing "superpower" result associated with your account
  • Account and profile details for Writers By Night HQ
  • Content you submit — community posts, homework, comments, questions, and manuscript excerpts or manuscripts you share for feedback, coaching, or evaluation
  • Video, audio, or text responses you submit through VideoAsk (for example, applications, onboarding questions, or testimonials)
  • Responses you provide when you fill out one of our forms (including forms we run through Kajabi or Google Forms)
  • Billing information you enter at checkout (see below regarding payment processing)
  • Any information you include when you email us or fill out a form

Payment information. When you purchase from us, payment is processed by Stripe (through Kajabi's checkout). We do not collect or store your full card number. We receive limited transaction details such as confirmation of payment, the last four digits of your card, and your billing name and email. For certain invoiced services, we may instead take payment through PayPal, which processes your payment under its own terms.

Information collected automatically. When you visit our site, we and our providers may automatically collect technical information such as your IP address, browser type and device, pages viewed, links clicked, referring website, and general location. We collect this using cookies and similar technologies (see Section 6).

Information from your interactions with Scribble. Writers By Night HQ includes an AI writing assistant called Scribble, which is a custom GPT you access on OpenAI's ChatGPT platform. Using Scribble may require your own OpenAI (ChatGPT) account, and when you use it, the prompts and text you enter are sent to and processed by OpenAI to generate responses, subject to OpenAI's terms and privacy policy. Please do not enter confidential information, or third-party material you do not have permission to share, into Scribble. How Scribble handles member content is also described in our Membership Terms.

What we do not intentionally collect. We do not seek out sensitive categories of information such as health, racial or ethnic origin, or financial details beyond what's needed to process a payment. Please don't send us sensitive personal information we haven't asked for.

  • Provide feedback, coaching, and manuscript evaluations you request

  • Comply with our legal obligations and enforce our terms

5. When and with whom we share information

We do not sell your personal information.

We may also disclose information if required by law, to protect our rights or safety or those of others, or in connection with a business transfer (such as a sale of the business).

6. Cookies and tracking technologies

Our site uses cookies and similar technologies to keep the site working, remember your preferences, understand how the site is used, and support our advertising. These include:

  • Essential cookies that make the site and checkout function
  • Analytics cookies (such as Google Analytics) that help us understand site usage
  • Advertising cookies (such as the Meta Pixel) that help us measure and target ads

You can control cookies through your browser settings, and you can opt out of certain advertising tracking through the ad platforms themselves. Blocking some cookies may affect how parts of the site work.

When you first visit writersbynight.com, we display a cookie banner, managed through our consent management provider [CookieScript], that lets you accept or decline non-essential cookies, including analytics and advertising cookies. We don't set those cookies until you consent, and you can review the specific cookies we use and change or withdraw your consent at any time through the cookie preferences link on our site.

7. Marketing emails and your choices

When you subscribe, we send newsletters, teaching content, and offers. You can opt out at any time by clicking the unsubscribe link at the bottom of any marketing email, or by emailing us at danielle@writersbynight.com. It may take a short time for the change to take effect. We will still send you necessary account and transactional messages (like receipts and renewal notices) even if you opt out of marketing.

Our marketing emails include our mailing address and an unsubscribe link, consistent with the U.S. CAN-SPAM Act.

8. How long we keep your information

We keep your information for as long as your account or subscription is active, and afterward for as long as we need it to run the business, meet legal and tax obligations, resolve disputes, and enforce our agreements. When we no longer need it, we delete it or anonymize it.

Content you post in the community may remain visible to other members until you or we remove it.

9. How we protect your information

We use reasonable technical and organizational measures to protect your information, and we rely on established providers like Kajabi and Stripe that maintain their own security standards. No method of transmission or storage is completely secure, so we can't guarantee absolute security. Keep your login details confidential, and let us know right away if you think your account has been accessed without your permission.

10. Your privacy rights

Depending on where you live, you may have rights over your personal information, including the right to:

  • Access the information we hold about you
  • Correct inaccurate information
  • Delete your information
  • Opt out of marketing
  • Ask us not to "sell" or "share" your information for targeted advertising (note: we do not sell your information)

To exercise any of these, email us at danielle@writersbynight.com. We'll respond as required by applicable law, and we won't discriminate against you for exercising your rights.

California residents. California law may give you additional rights regarding your personal information.

EU/UK residents. If you are in the European Economic Area or the United Kingdom, we process your personal information on one or more of these legal bases: your consent; performance of a contract with you; compliance with a legal obligation; or our legitimate interests in running and improving the business. You also have rights under the GDPR / UK GDPR, including access, correction, deletion, restriction, portability, and the right to object, as well as the right to lodge a complaint with your local data protection authority. To make a request, email us at danielle@writersbynight.com.
