Writers By Night — Sales Terms

These Sales Terms apply when you buy a one-time product or service from Writers By Night — for example, a workshop, a manuscript evaluation, or any other digital product or service we offer that isn't the HQ membership. (HQ membership is governed by our separate Membership Terms.)
By purchasing, you agree to these Sales Terms, along with our Privacy Policy and Website Terms of Use.

1. Making a purchase
You accept these Terms by checking the box to agree at checkout, and completing your purchase forms a contract of sale with us for that product or service. For any purchase we handle by custom invoice instead of our standard checkout (for example, a large manuscript evaluation), paying the invoice constitutes your acceptance of these Terms and of any scope of work we've agreed with you.
Prices are shown in U.S. dollars at checkout, and you're responsible for any applicable taxes. Payment is processed by Stripe through our checkout on Kajabi, or by PayPal for invoiced purchases. We may correct any obvious errors in pricing or product descriptions, even after you've placed an order, and if we do we'll let you know and give you the choice to proceed or receive a refund of anything charged in error.
2. Access and delivery
Digital products. For downloadable and on-demand digital products, you'll get access immediately or shortly after purchase, through your Kajabi account or a delivery link. At checkout you consent to receiving immediate access.
Workshops and live events. For live or scheduled events, we'll provide the details for attending after you register. Sessions may be recorded and made available afterward.
Services. For manuscript evaluations, coaching, and similar services, we'll arrange scheduling and delivery with you after purchase. Higher-value or ongoing services may also be covered by a separate agreement or scope of work, which will control if it conflicts with these Terms.
3. Refunds
Digital products. Because you receive immediate access to the content, all sales of digital products are final and non-refundable. You confirm this and consent to immediate access at checkout.
Workshops and live events. Registration fees for workshops and live events are non-refundable. If we cancel or reschedule an event and you can't attend the new date, we'll offer you a refund or a credit toward a future offering.
Services (manuscript evaluations and coaching). Once we've begun work on your evaluation or started your engagement, fees are non-refundable, because the work reflects time we've committed to you.
None of the above affects any rights you have under applicable law that can't be waived.
4. Your license to use what you buy
When you buy a digital product or materials from us, you get a personal, non-transferable license to use them for your own writing. You may not share, resell, redistribute, republish, or use our materials to create a competing product. All intellectual property in our products, materials, and frameworks — including the StoryPOWER System and related names and tools — remains ours. Don't share your account or access with others.
Feedback we give you on your own manuscript is yours to use. Your manuscript and creative work remain yours; buying an evaluation or coaching doesn't transfer any rights in your work to us.
5. What our products are (and aren't)
Our products and services are educational. We share teaching, tools, and feedback to help you strengthen your craft and finish your book. We make no guarantee about the results you'll achieve, including whether you'll finish, get published, or earn any income — those depend on many factors outside our control, including your own effort. Nothing we sell is legal, financial, or medical advice.
6. Limitation of liability
To the fullest extent permitted by law, we won't be liable for any indirect or consequential losses, or for lost profits, arising from a product or service you buy. If we're found liable to you in connection with a purchase, our total liability won't exceed the amount you paid us for the product or service the claim relates to.
Nothing here limits any liability that can't be limited under applicable law, including for our own fraud or for death or personal injury caused by our negligence.
7. Governing law
These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The state and federal courts located in New Mexico will have jurisdiction over any dispute arising out of a purchase or these Terms.
