Writers By Night HQ — Membership Terms

1. Welcome

Welcome to Writers By Night HQ. These Membership Terms explain how your membership works, what you can expect from us, and what we ask from you in return. By joining Writers By Night HQ ("HQ" or "the Membership"), you agree to these Terms, along with our Privacy Policy and Website Terms of Use. Please read them before you join.

HQ is operated by Danielle Kiowski, doing business as Writers By Night, a sole proprietorship based in New Mexico, USA. You can reach us at danielle@writersbynight.com

2. What Writers By Night HQ is

Writers By Night HQ is an ongoing membership for writers who want to build a sustainable writing practice, strengthen their craft, and finish their books. Your membership gives you access to a growing library of training, tools, community, and other resources built around the StoryPOWER System.

Because HQ is a living membership, its features may evolve over time as we improve the experience (see Section 12).

3. What your membership includes

While you're an active member, your membership includes access to things like:

  • The StoryPOWER System training library
  • New trainings released over time
  • Workshops, Q&A, and/or office-hours sessions
  • Downloadable tools, worksheets, and resources
  • Our member community space hosted on Kajabi
  • Scribble, our AI writing assistant (see Section 10)
  • Member tools such as the HERO Practice Tracker, Mission Generator, and Resistance Decoder
  • Bonus resources and updates added while you're a member

We describe these at a high level on purpose. The exact mix, schedule, and format of what's inside HQ may change over time while we maintain the overall value of the membership. Add-on products (for example, Level Up) may have additional terms specific to them.

4. Eligibility

To join HQ, you must be at least 18 years old, able to enter a binding contract, and not previously removed from HQ or another Writers By Night program for violating our terms.

5. Membership fees and payment

HQ is offered on a monthly or annual plan, at the price shown when you subscribe. Founders pricing, promotional pricing, or other rates may be available from time to time.

By subscribing, you authorize us to charge your chosen payment method on a recurring basis — monthly plans on the same day each month, annual plans on the same day each year — until you cancel. Payments are processed by Kajabi Payments through our checkout on Kajabi. Prices are shown in U.S. dollars, and you're responsible for any applicable taxes.

We may change the price of the Membership going forward. If we change the price of a plan you're on, we'll give you advance notice before your next renewal so you can decide whether to continue.

6. Founders and locked-in pricing

If you join at a founders rate or other locked-in price, that price stays in effect for as long as your subscription remains continuously active. If you cancel and later rejoin, you'll rejoin at the price then available, and a founders or promotional rate may no longer be offered.

7. Failed payments

If a payment fails, we (through Kajabi/Stripe) may automatically retry it. If we can't collect payment, we may suspend your access until payment is made, and if it stays unpaid, we may cancel your membership. You can rejoin later at the pricing available at that time.

8. Cancellation and refunds

Cancellation. You can cancel anytime from your account or by emailing us at danielle@writersbynight.com. When you cancel, your membership stays active through the end of the period you've already paid for, and you won't be billed again after that. We don't provide partial refunds for the unused part of a billing period.

Refunds. Because you get immediate access to the full HQ library and tools as soon as you join, membership fees are non-refundable, including for annual plans. Please review what's included, and reach out with any questions, before you join. This doesn't affect any rights you have under applicable law that can't be waived.

If we close HQ. We may discontinue HQ. If we do, we'll give you reasonable notice, and for any prepaid period you haven't used, we'll provide a pro-rated refund of the unused portion.

Cancellation by us. We may suspend or cancel your membership immediately if you don't pay, materially breach these Terms, or violate our community guidelines (Section 9).

9. Community guidelines

Our community only works if it's a safe, supportive place. As a member, you agree not to:

  • Harass, bully, threaten, or demean other members
  • Spam, or promote or solicit your own products, services, or clients without our permission
  • Post illegal content, or content that infringes anyone's copyright or other rights
  • Share other members' work, posts, or private discussions outside HQ
  • Disrupt sessions or the community

You're responsible for your own conduct, and we're not responsible for the conduct of other members. Violating these guidelines can result in removal from the community or termination of your membership, at our discretion.

10. Scribble (AI writing assistant)

Scribble is an AI-powered writing assistant designed to support your creative process inside HQ. Scribble is a custom GPT you access on OpenAI's ChatGPT platform, so using it may require your own OpenAI account, and your use is also subject to OpenAI's terms and privacy policy. A few things to understand about using it:

  • Scribble's responses are suggestions, not professional advice, and they may be inaccurate or incomplete.
  • You remain fully responsible for your own writing and for any decisions you make based on Scribble's output.
  • Please don't enter confidential information, or any third-party material you don't have permission to share, into Scribble.

How your interactions with Scribble are handled is also described in our Privacy Policy.

11. Your creative work (Creative Ownership)

You keep ownership of the stories, manuscripts, characters, and creative work you create and share inside HQ. Sharing your work in the community doesn't transfer your rights to us.

By posting your work inside HQ, you give us and other members a limited permission to view and discuss it within HQ for the purpose of feedback, discussion, and education. You can remove your work at any time by deleting your post where that's available. Please only share work that is yours to share.

12. Our intellectual property

Everything we provide inside HQ — trainings, videos, worksheets, tools, missions, diagrams, downloads, and the StoryPOWER System and related frameworks and names — is our intellectual property, and it stays ours. Your membership gives you a personal, non-transferable license to use these materials for your own writing while you're an active member.

You may not:

  • Share, resell, or redistribute our materials or downloads
  • Share your login or give others access to your account
  • Post, upload, or republish our content anywhere outside HQ
  • Use our materials to create a competing product or program
  • Use automated tools to scrape or copy HQ content

Your login details are personal to you. Keep them confidential, and tell us right away at danielle@writersbynight.com if you think someone else has accessed your account.

13. Workshops and recordings

Some HQ sessions may be recorded, and recordings may be made available to members afterward. If a session is recorded and you speak on camera or microphone, or your name is visible, that may be captured in the recording. Participation is always optional — you're welcome to take part by chat instead, keep your camera off, and change your display name to "Attendee" with your initials if you'd prefer not to be identified.

14. Changes to HQ

Because HQ is a living membership, we may add, retire, or update features, trainings, tools, software, and the community over time, and we may invite guest contributors. We'll do this while maintaining the overall value of the membership.

15. Availability

We work hard to keep HQ available, but we can't guarantee uninterrupted access. From time to time we may perform maintenance, update the platform, or experience outages beyond our control. HQ also depends on third-party platforms (like Kajabi), and we're not responsible for their outages. Please keep your own backup copies of anything you post or upload that matters to you.

16. Disclaimer

We make no guarantee about the results any member will achieve. HQ is educational, and whether you finish a manuscript, get published, or earn any income depends on many factors outside our control, including your own effort and circumstances. The trainings and materials provide general information and guidance, not bespoke professional, legal, financial, or medical advice, and we're not responsible for actions you take based on them.

17. Limitation of liability and indemnification

To the fullest extent permitted by law, we won't be liable for any indirect or consequential losses, or for lost profits, arising from your membership. If we're found liable to you in connection with HQ, our total liability won't exceed the total membership fees you paid us in the 12 months before the claim arose.

Nothing here limits any liability that can't be limited under applicable law, including for our own fraud or for death or personal injury caused by our negligence.

You agree to indemnify and hold harmless Danielle Kiowski / Writers By Night from any third-party claim, including reasonable attorneys' fees, arising out of your breach of these Terms or your violation of any law or the rights of a third party.

18. Confidentiality of other members

During your membership you may see personal or confidential information shared by other members. You agree not to disclose or misuse it, and this obligation continues even after you leave HQ.

19. Privacy

Your privacy is important to us. How we handle your personal information is described in our Privacy Policy at writersbynight.com/privacy. You're responsible for keeping your contact details accurate and up to date.

20. Governing law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. The state and federal courts located in New Mexico will have jurisdiction over any dispute arising out of the Membership or these Terms.

21. General

These Terms, together with our Privacy Policy and Website Terms of Use, are the entire agreement between us regarding your membership. If any provision is found unenforceable, the rest stays in effect. If we don't enforce a provision on any occasion, that isn't a waiver of our right to enforce it later. We may update these Terms from time to time; the current version will be posted, and we'll notify members of significant changes.
